S.J Hales Valuations

Verbal valuations are provided free of charge and without obligation for the purpose of sale by auction on individual items, specialist collections and entire house contents.

Clients are invited to visit us with their items for valuation during our normal office hours and do not have to make an appointment. We are happy to arrange a home visit.

For large estates, auctions can be conducted insitu.
Insurance and probate valuations

The staff at S.J.Hales auctioneers realise that the majority of our clients require a valuation figure as soon as possible. Our staff are trained to sensitively and efficiently produce a comprehensive appraisal that is usually ready within two working weeks. Our appraisals are competitively priced.

Together with delivering a fast valuation we believe in offering a high quality service. Each item is fully described to include artist or maker, origin, circa, medium, dimensions and provenance if known. The final document is supplied within a folder in the format of a full colour illustrated catalogue with title page and affidavit.

Each client receives two hard copies providing an invaluable reference in the event of loss or family division.


S.J.Hales was founded by Sara and Mark Hales who together bring over forty years of collective antiques experience including working as senior ceramics valuers for two of the world's top auction houses in London. Both have appeared as antiques experts on television, have written for various publications and have lectured. Sara has appeared on Flog It, Going for A Song and co- presented the popular ITV series 'Arts & Crafts'. She has also appeared as a regular antiques expert on BBC radio and LBC radio.

Mark's depth of knowledge has been called upon by many antique book authors, and his name appears frequently in the acknowledgments!! He has appeared as an antiques expert on television but, although invited to appear on programmes, prefers to leave the television work to his wife!!!

The success of SJ Hales has caused a stir in the national and specialist press with the Antiques Trade Gazette describing Mark and Sara as 'The Dynamic Duo'!!. They have achieved many world record breaking prices for their clients, with vendors from all over the world sending their collections to Devon for Mark and Sara to auction.

Mark and Sara live on a small farm with their two young sons, surrounded by numerous cats, dogs, guinea pigs, chickens, ponies and the dreaded 'four legged mortgages' the horses!!!!
Sara's interests outside of the business are her children and her horses, she is a keen horsewoman and competes regularly. Mark's interests are his children and working on diggers and tractors to improve the farm.

Carolyn Bell is our furniture expert and has an amazing depth of knowledge and passion for her subject. She has worked through out England as a consultant for various institutions . Carolyn lives in Lustleigh with her husband, two daughters and a dog surrounded by her collection of chairs!!

We are easily accessible to the A38/M5 and are only 15 minutes from Exeter airport.

We have limited parking on site but are within a short walking distance from a large car park.

Nearby are tea rooms, pubs, restaurants, numerous B & B's, hotels and we are only 5 minutes away from the beautiful moors.

General Conditions
BUYERS
1. CREDIT CARDS:
If you wish to pay by credit card there will be a charge of 3% of the total bill.

2. DEBIT CARDS:
There is no charge for debit card transactions. If you require clarification on any aspect of this please ask the Auctioneer or any member of their staff who will be happy to assist you.

3. Please make yourself fully satisfied as to condition of lot(s) before bidding.
We endeavour to give complete condition reports when requested but cannot be held responsible for errors in these condition reports.

BUYERS PREMIUM
1. A premium of 15% + VAT is charged on the hammer price of each lot, unless marked in the catalogue with a (+).

METHODS OF BIDDING
Bids may be made:

i) In person

ii) By completing and signing our standard bidding form

iii) By e-mail to be received by no later than 10am (UK time) on the morning of the Auction

iv) By telephone

v) By prior booking of a telephone line to bid for a specific item. This service is subject to line availability and is at the Auctioneers absolute discretion.

This service is subject to the Standard Conditions of Sale herein after appearing.

S. J. Hales executes absentee bids (under paragraphs ii, iii, iv & v above) as a convenience for Buyers and is not responsible for inadvertently failing to execute bids or for errors relating to the execution of such bids.

CLEARANCE
Lots can be paid for and cleared during the auction,

We are open on the day after the auction from 8.30 a.m to 5 p.m and during the week from 8.30 to 4p.m

DELIVERY
The Auctioneer will, if required, arrange postage of lots purchased, but can in no way be responsible for the time of delivery, damage or loss. An £8 plus vat package charge will be incurred.

DAMAGE TO LOTS
Any person causing damage to any lot will be held responsible for such damage, and the Auctioneer will be the sole judge in assessing the cost of such damage.




Standard Conditions
GENERAL DEFINITION
1. S. J. Hales & M.C.R Hales are the sole proprietors and trade as S. J. Hales Antique and Fine Art Auctioneers and Valuers. In these Conditions S. J. Hales who act only as Auctioneers and agents for the vendor, are called Auctioneers and representatives of S. J. Hales conducting the Auction are called The Auctioneer.

2.

i) Catalogue descriptions made by the Auctioneers as to the genuineness, attribution, origin, date, measurement, weight, condition or estimated selling price of any lot is a statement of opinion only. Neither the Auctioneer nor the Vendors make any warranty to Buyers in respect of the Lots. Any illustrations in the catalogue are solely for guidance.
ii) Each lot as set out in the catalogue or as divided or combined with any other lot or lots sold by the vendor with all faults, imperfections and errors of descriptions.

iii) S. J. Hales do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot, unless they have been instructed in writing by the vendor so to certify, and in such case the Auctioneers do so as agents of the vendor and are not themselves responsible for such claims.

iv) Any claim under statue must be received in writing by the Auctioneer within ten days of the day of sale.

THE AUCTION
3. The Purchaser of any Lot shall pay the hammer price plus a premium (together with VAT on the premium at the appropriate rate and on the hammer price at the appropriate rate if applicable on that lot). The highest bidder shall be the buyer except in the case of a dispute. If during the Auction the Auctioneer considers that a dispute has arisen, he has the absolute discretion to settle it or to re-offer the lot. The auctioneer may at his sole discretion determine the advance of bidding or refuse a bid.

4. The Auctioneer has absolute discretion to divide any lot, to combine any two or more lots or to withdraw any lot or lots from the sale, to refuse bids, regulate bidding or cancel the sale without in any case giving any reason or without previous notice.

5. All goods are put up for sale WITHOUT RESERVE at the Auctioneer's discretion unless written instructions as to the reserves are received prior to commencement of the sale.

6. Where a reserve is placed only the Auctioneer may bid on behalf of the Vendor.

7. The Auctioneer is entitled to amend any condition set out in 2. (i) from the rostrum prior to any bid being accepted for the lot.

8. Each purchaser shall forthwith give his/her names and permanent address and if so called to do so by the Auctioneers, shall forthwith pay to the Auctioneer 25% or more of the purchase money. If the purchaser fails to do so the lot may at the Auctioneers discretion be put up again and re-sold.

9. In the case of a lot being sold by Private Treaty, both the Vendor and Purchaser agree to be bound by the Conditions of Sale.

THE VENDOR
10. Rescission: not withstanding any other terms of these Conditions the Auctioneer will rescind the sale of any lot, and refund the purchase price, considered to be a deliberate forgery providing that:

i) Within five days after the sale S. J. Hales have received from the buyer of any lot notice in writing that in his view the lot is a deliberate forgery.

ii) Within twelve days after such notification the buyer returns the same to S. J. Hales in the same condition as at the time of the sale and by producing written evidence, the burden of proof to be upon the buyer.

11. Value Added Tax: A Vendor who sends for Sale by Auction or Private Treaty any item which is an asset of his business must disclose to the Auctioneers whether or not he/she is a registered person for Value Added Tax purposes in the UK or any other EU country and if so, declare his/her registration number whether or not he/she intends to operate the special scheme for second hand goods. This information must be specified at the time of entry.

12. The Vendor authorises the Auctioneer to deduct Commission and expenses at the stated rates from the hammer price and acknowledges the Auctioneer's right to retain any premium payable by the Buyer. The Vendor gives the Auctioneer full and absolute right to photograph and illustrate any lot placed in its hands for sale and to use such photographs and illustrations and any photographs provided by the Vendor at any time at its absolute discretion (whether or not connected with the Auction)

13. All goods on the Auctioneers premises and in their custody will be held insured against the risk of fire, theft following forcible entry, water damage and accidental breakage for which the Auctioneer is entitled to deduct 5% + VAT of the reserve.

14. The Auctioneer will normally account to the Vendor the proceeds of the sale (after deductions and expenses) within six weeks of the sale. The Auctioneer disclaim responsibility for the default by either the buyer or the vendor because they act, as agents for the vendor only and therefore do not pay out to the vendor until payment is received from the buyer.

15. Indemnity: The Vendor shall duly indemnify the Auctioneer against any claim in connection with any goods sold by the Auctioneer on the Vendor's behalf.

BUYERS
16. Inspection: Each Buyer by making a bid for a lot acknowledges that he/she has satisfied him/herself fully before bidding by inspection or otherwise as to all the sale conditions, the physical condition and description of lot including but not restricted to whether the Lot is damaged or has been restored or repaired. Each Lot is at the sole risk of the purchaser from the fall of the hammer. No lot may be removed by the purchaser from the premises until the purchase money for the lot and any other outstanding lots has been paid in full to the Auctioneer who may at his sole discretion refuse to accepted cheques other then those certified by a Bank.

17. No lots will be transferred under any circumstances.

18. Removal of goods: Purchasers are responsible for Lots purchased from the fall of the hammer. The Auctioneer will not be held responsible for loss or damage to goods sold. No purchase shall be claimed or removed until it has been paid for. All purchases shall be paid for and removed at the buyers risk and expense by the end of the fifth day after the sale, all lots not so removed shall remain at the risk of the buyer and subject to a minimum warehousing charge of £1 per lot per day (plus VAT thereon). If they are not paid for and removed within five days of the sale the Auctioneer may re-sell them by auction or privately without notice to the buyer. Auctioneer in respect of any loss shall be restricted to a maximum of the price paid by the buyer of the lot.

19. In the event of any failure of the buyer to comply with any of the above conditions the Auctioneer as agents for the Vendor shall following five days after the conclusion of the sale, be entitled at their absolute discretion to:

i) Rescind the sale of that or any other Lots sold to the defaulting Buyer.

ii) Without notice to the defaulting Buyer at any time will sell the Lot either by Public Auction or Private Sale.

iii) Proceed against the Buyer for damages for breach of contract.

20. Every bidder shall be deemed to act as principal unless there is in force a written acknowledgment by S. J. Hales that they act as agent on behalf of a named principal.

21. Each Purchaser by making his/her final bid for a Lot (whether by commission, on the telephone or in the saleroom) acknowledges that he/she has satisfied him/herself before bidding by inspection or otherwise as to the condition and description in accordance with Condition 2.

22. The Vendor and Auctioneer do not make or give, nor has any person employed by the Auctioneers any authority to make or give, any representation or warranty, nor are they responsible in any way for any representation or warranty of any statement in the catalogue or elsewhere concerning any Lot.

THIRD PARTY LIABILITY
23. Every person on S.J.Hales premises at any time shall be deemed to be there at his or her risk. He or she shall have no claim against S. J. Hales in respect of any accident which may occur or injury, damage or loss howsoever caused, save in so far as the injury, damage or loss shall be caused by the direct negligence of S. J. Hales employees.
